Terms of Service
1. Scope and Application These Terms of Service apply to all contracts concluded between a consumer or business entity (hereinafter referred to as the "Customer") and RetroBoy Plus LLC (hereinafter referred to as the "Seller") regarding all goods and services presented in the Seller Online Store. The inclusion of the Customer own terms is objected to unless otherwise agreed upon. These Terms also apply accordingly to the purchase and delivery of gift cards or promotional vouchers.
2. Order Process and Contract Formation The product descriptions in the Seller Online Store do not constitute legally binding offers but serve as an invitation for the Customer to submit a binding offer. The Customer can submit this offer via the integrated online order form. By clicking the final order button, the Customer submits a legally binding offer to purchase the goods in the shopping cart. The Seller may accept this offer within five days by sending a written order confirmation via email, by delivering the ordered goods, or by requesting payment. If multiple alternatives apply, the contract is concluded when the first alternative occurs. Order processing and contact are usually carried out via email. The Customer must ensure that the provided email address is correct and that spam filters do not block communications from the Seller.
3. Return Policy and Cancellations Detailed information regarding order cancellations and item returns can be found in our separate Return Policy. Please refer to that page for all rules regarding refunds and exchanges.
4. Prices and Payment Terms Unless otherwise stated in the product description, all prices are total prices. Any applicable delivery or shipping costs will be indicated separately during checkout. For deliveries outside the United States, additional costs may arise for which the Seller is not responsible, such as bank transfer fees, exchange rate fees, or import duties and customs taxes. These costs must be borne by the Customer. Depending on the selected payment method (e.g. PayPal, Amazon Payments, Stripe, or Shopify Payments), payment processing is handled by the respective payment service provider under their specific terms and conditions. The Seller reserves the right to perform credit checks and refuse certain payment methods if the check is negative.
5. Shipping and Delivery Conditions Goods are delivered to the shipping address provided by the Customer during the checkout process. If the shipping carrier returns the goods to the Seller because delivery was not possible, the Customer bears the costs for the unsuccessful delivery attempt. This does not apply if the delivery failure was due to circumstances beyond the Customer control. For logistical reasons, local pickup by the Customer is not available.
6. Retention of Title The Seller retains full ownership and title to the delivered goods until the purchase price has been paid in full.
7. Warranties and Limitation of Liability Unless expressly agreed otherwise, standard statutory warranty rights apply. For business entities, the Seller may choose the method of rectifying defects, and the warranty period for new goods is one year from delivery. Claims for defects in used goods are completely excluded for business entities. The Customer is required to inspect the delivered goods immediately upon receipt and report any obvious transport damage to the carrier and the Seller. Failure to do so does not affect the Customer standard warranty rights but helps the Seller claim damages from the carrier.
8. Custom Orders and Provided Content If the Seller processes goods according to specific Customer instructions, the Customer must provide all necessary content (text, images, graphics) in the required file formats and grant the Seller the necessary rights of use. The Customer guarantees that they have the legal right to use the provided material and that it does not infringe on any third party rights including copyrights and trademarks. The Customer agrees to fully indemnify and hold the Seller harmless against any third party claims arising from the use of the provided content, including all necessary legal defense costs. The Seller reserves the right to reject orders if the provided content violates legal prohibitions or is deemed offensive, discriminatory, or highly inappropriate.
9. Promotional Discount Codes Vouchers issued free of charge by the Seller as part of promotions (Promotional Codes) can only be redeemed in the Seller Online Store and only within the specified timeframe. Certain products may be excluded from the promotion. Only one Promotional Code can be redeemed per order. The goods value must equal or exceed the voucher value, and no remaining balances will be refunded or paid out in cash. Promotional Codes cannot be transferred to third parties.
10. Gift Cards Gift Cards purchased in the Online Store can only be redeemed in the Online Store. Gift Cards and any remaining balances can be redeemed until the end of the third year following the year of purchase. Gift Cards can only be applied before completing the order process and cannot be applied retroactively. Only one Gift Card can be used per order. Gift Card balances will not be paid out in cash and do not accrue interest.
11. Governing Law All legal relationships between the parties shall be governed by the laws of the State of Illinois, United States of America, excluding the laws governing the international sale of movable goods.
12. Dispute Resolution The Seller is neither obligated nor willing to participate in alternative dispute resolution proceedings before a consumer arbitration board. Any disputes arising from these Terms or your purchase shall be resolved exclusively in the state or federal courts located in Illinois.
